Only a pharmacist who is acting in the usual course of professional practice and who either is registered individually or is employed by a registered pharmacy, a registered central fill pharmacy, or registered institutional practitioner may fill a prescription for a controlled substance (21 C.F.R. § 1306.06). A pharmacist is defined as a person licensed by a state to dispense controlled substances as well as any other person (e.g., pharmacist intern) authorized to dispense controlled substances under the supervision of a pharmacist. Whether pharmacy technicians or other ancillary personnel may engage in dispensing controlled substances under the supervision of a pharmacist depends on state law. Individual practitioners also may dispense if authorized by state law.
